FTAIA No Limit To Antitrust Claims Jurisdiction: 3rd Circ.

Law360, New York (August 17, 2011, 5:55 PM EDT) -- The Third Circuit on Wednesday reversed its precedent that a law designed to rein in U.S. antitrust claims over foreign conduct limits the jurisdiction of federal courts, reinstating a six-year-old case over Chinese magnesite imports.

In a precedential opinion, a three-judge panel vacated the 2010 dismissal of a suit accusing Chinese mineral and metal producers of conspiring to fix the prices of their exports to the U.S. and remanded the dispute to the New Jersey district court.
