Judge OKs Medical Monitoring For DuPont Plaintiffs

Law360, New York (August 18, 2011, 6:40 PM EDT) -- A West Virginia state judge ruled Tuesday that several people who were part of a class action settlement against DuPont Co. over contamination at a zinc smelting plant can receive medical monitoring under that agreement, even as they sue DuPont for personal injuries.

Harrison County Circuit Judge Thomas A. Bedell ruled that medical monitoring for the plaintiffs in the present personal injury suit did not constitute “double-dipping” as alleged by DuPont.
