Masimo Hit With Oximetry Device IP Suit

Law360, New York (August 19, 2011, 7:27 PM EDT) -- Essential Medical Devices Inc. sued Masimo Corp. in Delaware federal court Friday, alleging it infringed a patent by developing noninvasive pulse oximetry devices two years after Essential Medical offered to sell it the patent in question.

The suit claims that Masimo has produced, marketed and sold pulse oximetry monitors and circuit boards infringing patented technology that analyzes levels of carboxyhemoglobin — a complex of carbon monoxide and hemoglobin — in red blood cells.

The suit also names Cercacor Laboratories, an independent entity spun off from Masimo in 1998...
