Fed. Circ.'s Latest Restriction On Method Patents

The patent reform bill passed by the House of Representatives and awaiting action by the Senate, H.R. 1249, contains a new procedure for reviewing the validity of finance-related business method patents, and provides additional defenses against infringement claims for patents on commercial processes. The United States Court of Appeals for the Federal Circuit, which has jurisdiction over all patent appeals, has been skeptical of business method patents, in some cases finding them outside of the scope authorized by Congress....
