Utilities Urge FERC To Revisit Planning, Cost Rule

Law360, New York (August 22, 2011, 6:25 PM EDT) -- A coalition of electric utilities on Monday asked the Federal Energy Regulatory Commission to reconsider a rule on transmission planning and cost allocation for public electricity transmission providers, saying it exceeds FERC's authority under the Federal Power Act.

The Coalition for Fair Transmission Policy, which includes Consolidated Edison Inc. and CMS Energy Corp. among its seven members, requested clarification or a rehearing on Order No. 1,000, a final rule FERC approved unanimously on July 21.
