Judge Strips Ethypharm's Antitrust Suit Over TriCor IP

Law360, New York (August 23, 2011, 8:36 PM EDT) -- A Delaware federal judge on Tuesday dismissed the bulk of Ethypharm SA France's suit accusing Abbott Laboratories of engaging in anti-competitive conduct in connection with a patent fight over Abbott's lucrative cholesterol drug TriCor, just weeks before the case is to go to trial.

Ethypharm brought the suit in March 2008, arguing that agreements Abbott entered with Reliant Pharmaceuticals Inc. — the U.S. distributor for Ethypharm's competing fenofibrate product Antara — were illegal and anti-competitive.
