7th Circ. Refuses To Order US Action On Invasive Carp

Law360, New York (August 24, 2011, 7:54 PM EDT) -- The Seventh Circuit on Wednesday denied requests by five state attorneys general to force the U.S. government to undertake measures to stop the migration of invasive Asian carp into the Great Lakes.

The appeals court ruled that ongoing federal efforts to prevent the fish from reaching the lakes outweighed the states’ calls for immediate relief, but stressed that it would revisit its ruling if circumstances changed.
