EMC Can't Stop Ex-Employee From Competing: 1st Circ.

Law360, New York (August 26, 2011, 7:44 PM EDT) -- The First Circuit refused Friday to bar a former EMC Corp. employee accused of using proprietary data from running a competing business or soliciting former co-workers, saying his contract's one-year time limit had already expired.

EMC had asked the court to expand the preliminary injunction that the Massachusetts district court issued against Christopher Blotto, which barred him from using any confidential business information he gained while working for the company but did not stop him from competing with EMC or soliciting its customers or employees....
