Judge Dismisses Playtex Patent Suit Vs. P&G

Law360, New York (November 6, 2003, 12:00 AM EST) -- U.S. District Judge Thomas Rose on Wednesday dismissed a patent-infringement claim by Sara Lee subsidiary Playtex Products against Procter & Gamble over a tampon applicator, the Associated Press reported.

The judge said P&G's Tampax Pearl Plastic tampon applicator does not violate the Playtex patent because the patent does not cover devices with entirely curved surfaces. The finger grip of the Playtex applicator has flat surfaces, while the Pearl Plastic applicator has curved, contoured surfaces.
