EEOC Focuses On Caregivers

Law360, New York (June 13, 2007, 12:00 AM EDT) -- On May 23, 2007, the Equal Employment Opportunity Commission issued “Enforcement Guidance: Unlawful Disparate Treatment of Workers with Caregiving Responsibilities." Although the Enforcement Guidance is not a binding legal authority, it will be followed by all EEOC offices to resolve charges raising such issues.

Further, courts may consider the Enforcement Guidance as persuasive authority in interpretation of statutory provisions. Thus, it is imperative for employers to be aware of situations in which the EEOC will find a violation of Title VII of the Civil Rights Act...
