Drug Co. Seeks Quick Win On False Ad Claims In IP Suit

Law360, New York (August 30, 2011, 4:01 PM EDT) -- A Puerto Rican drugmaker sought summary judgment Monday on false advertisement and unfair competition claims in its suit accusing a rival of infringing a trademark on a pain-relief drug and misleadingly marketing a product as equivalent to the drug.

International Ethical Laboratories Inc. asked a Puerto Rico federal court to rule Advanced Generic Corp. had violated the Lanham Act and Puerto Rico unfair competition and false advertisement law.
