ADA To Pay $33M In Clean Coal Trade Secret Fight

Law360, Washington (August 31, 2011, 4:41 PM EDT) -- Colorado clean coal company ADA-ES Inc. said Wednesday it would pay Norit International NV $33 million to resolve their breach of contract dispute involving alleged misappropriation of trade secrets for the construction of a manufacturing facility.

Norit, an activated carbon producer, claimed ADA stole its intellectual property and used it to build a facility at Red River near Coushatta, La., that is operated by ADA Carbon Solutions LLC, known as ACS. In April an arbitration panel ruled that ADA should pay Norit $37.9 million and royalties....
