Fed. Circ. Gives Rock-Grinding Patent New Life

Law360, New York (August 31, 2011, 8:28 PM EDT) -- The Federal Circuit on Wednesday reversed the invalidation of a patent held by Magotteaux International SA for rock-grinding technology, finding the lower court had improperly held that the patent recaptured subject matter surrendered during reissue examination.

The ruling also immediately reinstates a limited exclusion order issued by the U.S. International Trade Commission on products made by accused infringer AIA Engineering Ltd. The order had been lifted pending the outcome of the Federal Circuit proceeding, said Robert S. Rigg of Vedder Price PC, an attorney for Magotteaux....
