WTO Finds US Clove Cigarette Ban 'Legitimate'

Law360, New York (September 2, 2011, 3:27 PM EDT) -- A World Trade Organization panel found Friday that a U.S. ban on clove cigarettes flouted some international trade rules, but rejected Indonesia's claim that the measure aimed at reducing youth smoking was unnecessary.

The panel said in a report that while the law was discriminatory because it banned clove but not menthol-flavored cigarettes, it was not unnecessary. As such, the panel concluded by requesting that the U.S. bring the regulation in line with trade rules.
