J&J Supplier's Bug Infestation Suit Survives Dismissal Bid

Law360, New York (September 12, 2011, 9:59 PM EDT) -- A Florida federal judge on Monday refused to toss a Johnson & Johnson supplier's suit against a warehouse owner over an alleged beetle infestation in the facility, ruling that the economic loss rule did not bar the supplier's claims.

U.S. District Judge Cecilia M. Altonaga said the economic loss rule did not bar Gomez Packaging Corp.'s claims of negligence and negligent misrepresentation against Smith Terminal Warehouse Co., but ruled that Gomez would need to amend the complaint to clarify its breach of bailment claim.
