4th Circ. Expands Religious Groups' Title VII Exemption

Law360, New York (September 14, 2011, 7:31 PM EDT) -- The Fourth Circuit said on Wednesday that religious organizations are exempt from religious harassment and retaliation suits, reversing a lower court ruling that a nursing assistant fired by her Catholic nursing home employer could sue on those grounds.

Writing for the majority in a published opinion, Circuit Judge Dennis W. Shedd said that when the U.S. Congress had crafted the religious organization exemption for Title VII of the Civil Rights Act — which bars religious discrimination by employers — it had intentionally used the broad term...
