Adidas Says Herbalife Breached Tri-Leaf Logo Deal

Law360, Los Angeles (September 20, 2011, 3:11 PM EDT) -- Sportswear maker Adidas America Inc. on Monday asked an Oregon federal judge to find that nutrition products maker Herbalife International Inc. breached a provision of the companies’ 1998 trademark settlement agreement by using Herbalife’s tri-leaf logo without putting its name nearby.

Adidas filed a motion for summary judgment arguing that the court’s earlier order finding Herbalife had breached a settlement term barring it from putting the tri-leaf mark on sportswear also meant that the nutrition maker had breached a separate provision requiring it to always place...
