EPA, W.Va. Sue City Over Sewer Overflows

Law360, New York (September 20, 2011, 7:17 PM EDT) -- Federal and state environmental officials sued Welch, W.Va., on Tuesday, alleging its wastewater treatment plant and sewer system discharged pollutants into the Ohio River and other bodies of water in violation of the Clean Water Act.

The city and the Welch Sanitary Board violated permits issued under the National Pollutant Discharge Elimination System, as well as the CWA and the West Virginia Water Pollution Control Act, the suit contends.
