Microsoft Wants New Motorola Evidence Nixed In ITC Suit

Law360, New York (September 20, 2011, 6:20 PM EDT) -- Microsoft Corp. on Monday accused Motorola Mobility Inc. of making an end run around the U.S. International Trade Commission's rules by attempting to raise lengthy new arguments weeks after the conclusion of hearings in Microsoft's smartphone patent case against it.

Microsoft told the ITC that Motorola had violated the page count restrictions for posthearing briefs by submitting a voluminous list of new evidence and arguments in its defense against allegations that it infringes Microsoft's patents by importing and selling Android-based mobile devices.
