Chile Clears Airlines' Merger With Conditions

Law360, New York (September 21, 2011, 7:09 PM EDT) -- Chile's antitrust court ruled Wednesday that LAN Airlines SA could go ahead with its merger with Brazilian carrier TAM SA if the companies agree to a series of conditions, including giving up slots at Sao Paulo's main airport.

The split decision to permit the transaction comes six months after the the Chilean Competition Tribunal, known as TDLC, agreed to investigate the deal at the behest of a Chilean consumer group, despite a request from the national competition prosecutor to let the deal go forward.
