EU Court Rejects Nike's 'Dynamic Support' Trademark Bid

Law360, New York (September 21, 2011, 6:09 PM EDT) -- The European Union's General Court on Wednesday affirmed the rejection of Nike International Ltd.'s application for a trademark on the term "dynamic support," ruling the phrase was merely descriptive for footwear.

The court denied Nike's request that it annul an August 2010 decision by the Office for Harmonization in the Internal Market, which concluded that the company had failed to produce evidence that the proposed mark had a distinctive character necessary for trademark protection.
