LaGen's Pollution Coverage Suit Will Stay in La.: Judge

Law360, New York (September 23, 2011, 3:43 PM EDT) -- A federal judge on Thursday denied Illinois Union Insurance Co.'s motion to dismiss or transfer a dispute over potential Clean Air Act liability for an insured NRG Energy Inc. subsidiary, ruling that both the coverage dispute and the underlying environmental suit should be litigated in Louisiana.

U.S. District Judge James Brady said sending the suit to New York, as requested by the insurer, would create a "vicious cycle of litigation," given that a New York judge had already decided the case should be heard in Louisiana....
