Syngenta Vows To Appeal After Stinging Defeat In Patent Suit Vs. Rivals

Law360 (December 15, 2004, 12:00 AM EST) -- Swiss agrochemical company Syngenta AG has vowed to appeal a decision by a Delaware court that favored rivals Monsanto Co. and Dow Chemical Co. in a dispute over biotech patents for insect-resistant corn.

On Tuesday, the U.S. District Court for the District of Delaware found that Monsanto and Dow AgroSciences did not infringe on a Syngenta patent.

In a stinging defeat for Syngenta, the jury also held that the patent was invalid due to obviousness, considering earlier work in the field by others.
