Fed. Circ. Nixes $29M HemCon Hit In Polymer Patent Suit

Law360, New York (September 26, 2011, 7:30 PM EDT) -- The Federal Circuit on Monday overturned a $29 million damages award against HemCon Medical Technologies Inc. for allegedly infringing Marine Polymer Technologies Inc.'s patent for a polymer that accelerates hemostasis, saying the scope of the patent changed during a re-examination proceeding.

In a split decision, the appeals court concluded that HemCon had absolute intervening rights because Marine Polymer changed the scope of the patent during the re-examination, but remanded the issue to a New Hampshire federal court of whether the company also had equitable intervening rights....
