Supreme Court Mulls TCPA’s Quirks In Sallie Mae Suit

Law360, New York (November 28, 2011, 6:44 PM EST) -- The U.S. Supreme Court grilled lawyers for a Sallie Mae unit and a consumer on Monday over whether Telephone Consumer Protection Act suits are limited to state court, in a jurisdictional debate prompting justices to call the TCPA "strange" and "so weird."

The TCPA, which regulates telemarketing, stipulates that consumers “may, if otherwise permitted by the laws or rules of court of a state” bring actions under the law in state courts but says nothing about whether they can also wield the TCPA in federal court....
