Judge Trims Birds Eye Foods Cleanup Suit

Law360, New York (September 27, 2011, 3:05 PM EDT) -- A Michigan federal judge ruled Monday that a citizen suit alleging Birds Eye Foods LLC contaminated groundwater with waste from a fruit processing plant was too vague to proceed in its current form, but allowed the plaintiffs the chance to modify most of their claims.

U.S. District Judge Paul Maloney cut counts of trespass and abnormally dangerous activity from an amended complaint filed by more than 70 Michigan property owners, but said the plaintiffs could replead counts of negligence and cost recovery that he found deficient....
