EPA Can't Shake Challenge To Aquatic Pesticide

Law360, New York (September 28, 2011, 1:28 PM EDT) -- An Arizona federal judge on Tuesday denied efforts by the U.S. Environmental Protection Agency to dismiss a lawsuit over its reregistration of the piscicide rotenone, finding that the Endangered Species Act challenge belongs in district court.

The EPA moved to dismiss the suit, brought by the Council for Endangered Species Act Reliability, for lack of jurisdiction. The suit alleges that the agency violated the ESA by not consulting with the U.S. Fish and Wildlife Service when it reregistered rotenone for use as an aquatic pesticide....
