Fed. Circ. Chief Calls For Cheaper Patent Litigation

Law360, New York (September 27, 2011, 7:44 PM EDT) -- Federal Circuit Chief Judge Randall Rader summed up the state of patent litigation in two words Tuesday — “needs improvement" — elaborating that the system was too expensive, especially with ballooning discovery costs.

In a speech to the Eastern District of Texas Bench and Bar, Judge Rader identified six areas of improvement for patent litigation and unveiled a proposed model e-discovery order for patent cases developed by the Advisory Council of the Federal Circuit with an eye toward streamlining e-discovery to rein in costs.
