Kellogg, Rival Settle Veggie Trade Dress Suit

Law360, Los Angeles (September 28, 2011, 7:42 PM EDT) -- Kellogg North America Co. on Wednesday settled a trade dress infringement suit in Michigan federal court against a rival frozen vegetarian food maker it accused of ripping off its Morningstar Farms brand packaging in hopes of boosting sales.

Kellogg and competitor Tribe Mediterranean Foods Inc. filed a proposed stipulation of dismissal without prejudice Monday and U.S. District Judge Robert J. Jonker signed the order Wednesday, ending the litigation.

Terms of the settlement were not immediately available.
