Fed. Circ. Revives Powertech IP Suit Over Tessera Chip

Law360, New York (September 30, 2011, 4:55 PM EDT) -- Finding that a controversy exists between the parties, the Federal Circuit on Friday reversed the dismissal of a declaratory judgment suit by Powertech Technology Inc. seeking a ruling that it did not infringe a semiconductor patent held by Tessera Inc.

The appeals court found that U.S. District Judge Claudia Wilken of the Northern District of California erred in June 2010 when she granted Tessera's motion to dismiss for lack of subject matter jurisdiction. Judge Wilken had found there was no controversy because Powertech's products were made...
