Brazilian, Chilean Airlines Challenge Merger Conditions

Law360, New York (October 4, 2011, 8:29 PM EDT) -- Chile's LAN Airlines SA and Brazilian carrier TAM SA on Monday challenged several conditions Chile's antitrust court placed on their planned merger but said Tuesday they still planned to close the deal in early 2012.

In particular, the carriers appealed requirements that they receive preclearance for certain code-sharing agreements, that they give up certain rights involving flights to Peru, and that they submit to monitoring from Chile's national economic prosecutor and an outside consultant.
