Audio Co. Can't Trademark Loudspeaker Design: EU Court

Law360, New York (October 6, 2011, 6:22 PM EDT) -- A European Union court on Thursday ruled that Danish electronics manufacturer Bang & Olufsen AS could not trademark its design for loudspeakers, finding that because the selling point of the speakers was their shape, that shape could not be trademarked. 

The EU General Court upheld an earlier decision by the Office for Harmonization in the Internal Market that denied the company’s application to obtain a community trademark for its BeoLab 8002 speakers, which would be enforceable throughout the European Union.
