Insurer Can't Dodge Damages In Moldy RV Suit: 1st Circ.

Law360, New York (October 7, 2011, 8:10 PM EDT) -- The First Circuit ruled Friday that Insurance Co. of the State of Pennsylvania could be liable under an excess insurance policy held by bankrupt Monaco Coach Corp. in a suit seeking damages for an allegedly defective Monaco-made motor home.

The appeals court reversed the Rhode Island federal court's decision granting ICSOP summary judgment, ruling that a state statute allowing tort victims to recover damages directly from liability insurers of a bankrupt tortfeasor overruled a provision in the policy that said ICSOP's duty to pay arose only...
