Fed. Circ. Chops Down Canex Lumber Imports Case

Law360, San Diego (October 12, 2011, 3:36 PM EDT) -- The Federal Circuit on Wednesday upheld the dismissal of Canex International Lumber Sales Ltd.’s case alleging that U.S. Customs and Border Protection misclassified the company's lumber products and gave improper notice before liquidating them.

In a brief order, the three-judge panel backed the U.S. Court of International Trade’s ruling of summary judgment in favor of the U.S. government after it found that Customs did not violate the law when it liquidated Canex’s imports, and that the agency correctly classified Canex’s products as sawn lumber.
