Colo. County Atty Can't Sue City Under CWA: 10th Circ.

Law360, New York (October 13, 2011, 6:18 PM EDT) -- A county district attorney does not have standing to sue a Colorado city under the Clean Water Act, the Tenth Circuit ruled Wednesday, upholding a lower court's decision to throw out the attorney's claims that the city polluted waterways with untreated sewage.

The court found Pueblo County District Attorney Bill Thiebaut did not have standing to sue the city of Colorado Springs or its public wastewater utility in his official capacity.
