In Policy Overhaul, India Allows Drug Patents

Law360 (January 3, 2005, 12:00 AM EST) -- In a move likely to shake up the global drug industry, India has finally adopted product patents as part of a major overhaul of the country’s intellectual property regime.

As the calendar turned to 2005, India adopted the product patent regime for food, drugs and chemicals and embedded software. By presidential decree, India met a World Trade Organization (WTO) commitment to recognize foreign patents from Jan. 1, the culmination of a 10-year process.
