Discovery From Social Media Sites Rising, Survey Says

Law360, New York (October 18, 2011, 5:17 PM EDT) -- Even though discovery requests for information from Facebook, Twitter and other social media sites are on the rise, companies are increasingly allowing their employees unfettered access to the websites, according to a Fulbright & Jaworski LLP report released Tuesday.

Of the U.S. companies surveyed, 7 percent have been forced to produce electronically stored information from a social media website for discovery in the past year, up from 4 percent in 2009, Fulbright's 2011 Litigation Trends Survey Report said. The law firm surveyed 275 senior corporate counsel...
