Nomir, McDermott Bury $143M Patent Malpractice Suit

Law360, San Diego (October 20, 2011, 3:28 PM EDT) -- Nomir Medical Technologies Inc. on Thursday resolved a patent malpractice and contract dispute with McDermott Will & Emery LLP that had accused three of the firm’s attorneys of missing patent filing deadlines and costing the medical device maker at least $143 million.

U.S. District Judge William Young dismissed the case in Massachusetts federal court without costs and without prejudice in light of the settlement, but gave the parties 30 days to reopen the action if the deal was not consummated.
