BASF's Supplement Tariff Challenge Merits Trial: Judge

Law360, New York (October 20, 2011, 6:32 PM EDT) -- A U.S. Court of International Trade judge on Wednesday denied chemical maker BASF Corp.'s motion for summary judgment in a case in which the company is challenging the customs classification of the dietary supplement Betavit.

BASF asked the court to rule that the beta-carotene product is not subject to any import duties, but CIT Judge Evan J. Wallach concluded that the issues in the case are fact-intensive and better suited for trial.
