Evergreen Asks Judge To Allow Stalking Horse Bid

Law360, New York (October 24, 2011, 7:17 PM EDT) -- Bankrupt solar cell maker Evergreen Solar Inc. on Monday urged a Delaware bankruptcy judge not to kill a stalking horse bid from its secured lenders, despite some creditors' objections.

Evergreen called "meritless" the complaints by the committee of unsecured creditors, which had asked U.S. Bankruptcy Judge Mary F. Walrath to stop a $60 million stalking horse bid led by senior lenders and had said those lenders had claimed liens and security interests in Evergreen assets to which they were not actually entitled.
