BorgWarner Targets Cummins Over Turbocharger Patents

Law360, New York (October 26, 2011, 10:17 PM EDT) -- BorgWarner Inc. hit rival auto components maker Cummins Inc. with a patent infringement suit Wednesday in North Carolina federal court, accusing it of violating three patents related to the design and production of engine turbochargers.

In its complaint, BorgWarner claims it notified the Columbus, Ind.-based engine parts manufacturer about the three patents in October 2006, yet Cummins still allegedly infringed the patents in “willful blindness.”

Cummins subsidiary Cummins Turbo Technologies Ltd. is also named as a defendant in the suit.
