MercExchange Vs. eBay Could Set Precedence For Business Method Patents

Law360, New York (January 12, 2005, 12:00 AM EST) -- The Federal Circuit’s decision in MercExchange’s closely watched patent lawsuit against eBay could have broad implications for so-called business-method patents, intellectual property attorneys say.

A decision in the case, which pits an electrical engineer from Ohio against one of the world’s leading internet companies, is expected any day now. The Washington, DC appeals court will decide whether to uphold the May 2003 jury verdict ordering eBay to pay MercExchange founder Thomas G. Woolston $35 million for infringing on his patents.
