CVS, KV Resolve $100M Suit Over Drug Supply Contract

Law360, New York (November 7, 2011, 8:16 PM EST) -- CVS Pharmacy Inc. on Monday asked a court to dismiss its $100 million contract dispute with KV Pharmaceutical Co. over KV's alleged failure to supply certain generic drugs to CVS following a recall, saying the required terms of their July settlement agreements had been satisfied.

In a joint motion filed in Rhode Island federal court, CVS asked the court to dismiss the case with prejudice, stating that the defendants — KV and one of its subsidiaries — had agreed to the proposed dismissal after certain terms...
