EC Calls For Nestle To Divest In Novartis Union

Law360, New York (July 2, 2007, 12:00 AM EDT) -- The European Commission has allowed Nestle to acquire Novartis Medical Nutrition for $2.5 billion, but only after the companies agreed to sell businesses in France and Spain.

The Commission said Friday that the transaction would have significantly impeded competition for liquid health care nutrition, which is delivered to patients via the intestinal tract either orally or through tubes. The deal gives Nestle control of the brands Boost, Resource, Optifast and Nutrisource.
