Mo. Court Rejects Challenge To Electricity Rate Increase

Law360, New York (November 8, 2011, 7:45 PM EST) -- A Missouri appeals court ruled Monday that the Missouri Public Service Commission was within its authority to grant Union Electric Co. a $161.7 million annual rate increase in the state, affirming the commission’s earlier decision.

The Missouri Office of the Public Counsel — which represents rate payers before the commission — and aluminum manufacturer Noranda Aluminum Inc. contended in their appeal of the January 2009 order that the commission had been unreasonable in calculating several critical factors in the rate increase.
