Appeals Court Sides With Honda In ATV Burn Suit

Law360 (July 5, 2007, 12:00 AM EDT) -- In a victory for American Honda Motor Co., an appeals court has affirmed a lower court's decision to toss a diabetic's product liability claim that the automobile maker's all-terrain vehicle caused burns on his feet.

The U.S. Court of Appeals for the Eleventh Circuit on July 3 affirmed a ruling by the U.S. District Court for the Southern District of Alabama that granted Honda's motion for summary judgment against Richard Phillips, an Alabama resident who alleged that Honda's ATV was “unreasonably dangerous.”
