Va. Judge Zaps Town's Go-Ahead For $6B Power Plant

Law360, New York (November 22, 2011, 4:58 PM EST) -- A town council in southeastern Virginia unlawfully rezoned land to make way for a $6 billion coal power plant proposed by Old Dominion Electric Cooperative, a state judge ruled Monday in a citizen suit against the town and company.

The Dendron, Va., town council failed to properly notify the public before it voted to approve four land use applications for the Cypress Creek Coal Plant and amend the town’s zoning plan in a February 2010 meeting, Judge Samuel Campbell ruled.
