Arch Can't Wash Away Hurricane Wilma Coverage Suit

Law360, New York (November 28, 2011, 2:01 PM EST) -- A Florida federal judge last week refused to nix a property management company’s suit seeking more than $8.5 million in excess coverage from Arch Specialty Insurance Co. for damage sustained to several apartment complexes during Hurricane Wilma.

Arch argued that the court should toss Banta Properties Inc.’s complaint because the company waited nearly two and a half years after Hurricane Wilma caused the alleged damage to file its claim with the excess insurer.
