Allergan Sues Apotex Again Over Generic Pinkeye Drug

Law360, New York (November 29, 2011, 3:31 PM EST) -- Allergan Inc. and two Japanese pharmaceutical companies sued generics maker Apotex Inc. again in Delaware on Monday, alleging it has infringed a recently re-examined patent in seeking approval for a generic version of pinkeye treatment Zymar.

The suit — brought by Allergan, Senju Pharmaceuticals Co. Ltd. and Kyorin Pharmaceuticals Co. Ltd. — accuses Apotex of infringing an amended claim and several recently added claims of a patent that was re-examined this year at the request of patent owners Senju and Kyorin.
