Asarco Faces Hiccup In Freeport Cleanup Settlement

Law360, New York (December 1, 2011, 5:55 PM EST) -- Asarco LLC has settled claims against Freeport-McMoRan Copper & Gold Inc. over cleanup costs at a Montana Superfund site, but a judge rejected the deal Tuesday because Asarco did not indicate whether it had notified a nonsettling defendant about the agreement.

The company sued Freeport-McMoRan, related entities Amax Exploration Inc., Cyprus Amax Minerals Co., Phelps Dodge Corp. and Hecla Mining Co. in federal court in April, seeking contributions related to $9 million it incurred for responses to heavy metals and arsenic contamination at a portion of...
